Sample Rental Agreement

This Agreement is entered into by 469 Chocolate Hole, LLC (“Owner”) located at 522 Queen Street in Alexandria, VA 22314, and {{GuestFullName}} residing at {{GuestAddress}} (“Guest”) for the sole purpose of Guest rental of the {{VillaName}}home and grounds located at 469 Great Cruz Bay Road, St. John VI 00830 (“Property”) from {{Arrival}} to {{Departure}}. This Agreement is in addition to any terms listed on a travel or vacation rental home website ("Travel Website"), if any, where Guest may have initiated this rental.  In the event of conflicting terms between this Agreement and terms listed on Travel Website, the terms of this Agreement will prevail over the terms listed on Travel Website.

Guest Use Restrictions - Violations Result in Immediate Eviction with No Refund

  • No subletting or reserving Property for other people. 

  • Maximum occupancy is 4 people.

  • No events  such as weddings, receptions or other events can be held on Property - events are prohibited by HOA rules.

  • No smoking or vaping  of any substance is permitted inside villa – please go outdoors.

  • No pets, including service animals, are allowed on Property.

Cancellation Requests  must be made in writing. Refunds, if any, are subject to the following terms:

  • Full Refund if Agreement is cancelled more than 60 days before arrival date.

  • Partial Refund for "Paid-In-Full" Reservations cancelled less than 60 days before arrival date.  If Owner is able to re-rent some or all of Guest cancelled dates, Owner will refund all amounts collected from the replacement guest.  This results in a partial refund because renting cancelled dates on short-notice requires discounting rental prices.  If Owner is unable to re-rent Guest cancelled dates, Owner will refund 12.5% VI hotel tax, cleaning and ADW fees 

  • No Refund for "Partially-Paid" Reservations cancelled less than 60 days before arrival date.  A maximum grace period of 5 days will be given for Guest's final payment, and reservation will be automatically cancelled 55 days prior to Guest arrival date.  if Cancelled dates can be reinstated by Guest paying reservation in-full provided cancelled dates have not been re-rented.

 

Hurricane Rescheduling:  Should the United States National Oceanic and Atmospheric Administration (NOAA) forecasters predict that St. John and/or St. Thomas will experience at least "Category 1 Hurricane" force winds (i.e. steady winds greater than 74 mph, with stronger gusts possible) during Guest reservation dates, Guest reservation will be cancelled by Owner and Guest will be given full credit for all payments made towards a future stay in the Property. Future stay credit will not be offered should NOAA forecast that St. John and/or St. Thomas will experience "Tropical Storm" force winds or less (i.e. steady winds less than 74 mph, with stronger gusts possible) during Guest reservation dates. Future stay credit will also be given in the event that a prior hurricane or other event disrupts and/or damages St. John infrastructure such that where there will be no electrical power and/or water available at Property during Guest reservation dates. Future stay credits do not expire and will only be issued in these specific scenarios.

 

Guest is Advised to Purchase Travel Insurance should Guest wish to receive cash refunds for flights, accommodations, and/or other expenses incurred as a result of Guest's inability or unwillingness to travel to or stay in Property during their reservation dates. Guest is advised to purchase maximum protection insurance, typically referred to as “Cancel For Any Reason” (CFAR) travel insurance, which covers the maximum amount of scenarios that might limit or prevent Guest from staying in Property during Guest reservation dates.

Use of Pool:  Guest assumes all responsibility for any and all persons visiting Property during the rental dates and agrees to inform such persons ("Guest Visitors") that pool use can be dangerous, can result in injury or death and that they enter at their own risk. Guest assumes responsibility for ensuring proper supervision of pool, particularly when children are present on the premises.

Use of  Property does not extend to rocky cliff areas.  The rocky cliffs that the Property was built on are very dangerous and are explicitly restricted for use by Guest and Guest Visitors.   Attempting to climb down any of these cliffs may result in serious injury or death and Guest agrees to inform all Guest Visitors of this restriction.   Guest accepts personal responsibility for any Guest Visitor that violates this restriction and agrees to fully indemnify Owner for any and all costs associated with legal actions that may arise out such violation.

 

Lost Property: Guests are advised that lost or stolen personal items are not the responsibility of the owner. Guests will have up to two sets of keys and are responsible for locking the villa and safekeeping of personal items during their visit. Owner assumes no responsibility for items left behind at the villa but will request that his property manager and housekeeper make best efforts to locate and return missing items if found. Guest will be responsible for postage.

$500 Accidental Damage Waiver  ("ADW") covers reported accidental damage to Property up to $500. The ADW fee is non-refundable if Guest stays in Property but is refundable if Guest reservation is cancelled for any reason. ADW does not cover intentional damage or vandalism of the property, in which case Guest will be fully responsible to reimburse Owner for repairs, including any loss of rents from subsequent guests should repairs impact their stay requiring partial refund or cancellation. If Travel Website collects a security deposit in lieu of ADW, then the cost to repair any damage will be collected from security deposit. Guest is responsible to reimburse Owner for accidental damage exceeding the ADW $500 protection limit or Travel Website security deposit amount, and/or for 100% of any intentional damage caused by Guest, within 14 days of Owner providing Guest with receipts for such damage.

 

Agreement constitutes a temporary license to occupy property with no intention to create Tenant rights. Owner's representatives reserve the right to access property to verify compliance with terms of Agreement and effect repairs to Property. If Guest or persons staying with Guest do not vacate Property by departure time on departure date, Guest will reimburse Owner twice the daily rate for the departure day and each subsequent date, plus any amount Owner refunds to subsequent guests whose reservation were impacted by the refusal to vacate Property on the departure date.

Rental rate shall not be adjusted due to cleanliness or maintenance issues identified by Guest during their stay. Should Guest discover issues during their stay, Guest must notify Owner's cleaner and/or Owner's property manager using phone numbers posted in Property manual located in the kitchen. Owner’s representatives will address issues raised in a timely and professional manner with the goal of resolving most issues identified typically within a few hours, but on weekends could take up to 48 hours.  St. John is a remote island that lacks quick access to many parts, appliances, furniture and other items that may be needed to resolve maintenance issues, hence Guest is advised that repairs may not be resolved during Guest stay in Property.

Owner is not responsible for events beyond Owner’s control, including but not limited to inclement weather, natural disasters, travel issues, construction noise on neighboring properties, or any damage or loss to Guest property from weather, theft, vandalism or vehicular accident.

Property is treated monthly for pests  as St. John is heavily wooded with a large number of insects and other wildlife such as lizards, squirrels, and snakes. Guest is advised to keep doors & windows closed to prevent pests and wildlife from entering home, and to respect, maintain safe distance from, and not feed nor engage with local wildlife in any way.

Guest agrees to hold harmless and indemnify Owner against all loss, damage or expense arising from (a) any action of Guest or Guest Visitor which causes illness, injury or death to any person, (b) illness, injury or death related to Guest, Guest Visitor or Pool Guest use of pool, stairs, decks, systems, furniture, appliances, landscaping or other aspect of the Property, (c) theft of items during Guest stay, and/or (c) the presence of hazardous materials, animals, insects, microorganisms or viruses on the premises. Under no circumstances shall Guest be entitled to recover consequential, incidental or punitive damages from Owner.

Guest agrees that their electronic signature was legally applied when typing their name and checking the box on the checkout page when reserving Property, and that their electronic sign is equivalent to a physical signature for the purposes of validity, enforce-ability and admissibility.  Guest further acknowledges that by making the initial deposit on the reservation  that Guest accepts this Agreement in its entirety.  Owner and Guest further agree that this Agreement can be amended by mutual consent of Owner and Guest by typing their full names via email exchange and stating "I accept" below any specific language that is mutually agreed to be added or deleted as an addendum to the Agreement.

Agreement shall be governed solely by laws of the Commonwealth of Virginia. If any section, clause, paragraph or term of Agreement is held or determined to be void, invalid or unenforceable, for any reason, all other terms, clauses or paragraphs herein shall be severed and remain in force and effect. Any and all disputes arising out of or related to this Agreement, regardless of form of action or theory (whether in contract, tort, charge-back via Travel Website, charge-back via bank payment method or otherwise), whether initiated by Owner, Guest, Guest Visitor or other party, shall use the court systems of Alexandria, Virginia as the exclusive venue.
